Terms of Use and Privacy Policy
These are the same agreements you accept in the Sunshine Send app.
Sunshine Send Terms of Use Version 1.1 | Effective 15 October 2026
These Terms of Use ("Terms" or "Agreement") are a contract between you and Sunshine Send, Inc. trading as Sunshine Send ("Sunshine Send," "we," "us," or "our"), a company registered in Delaware, United States. This Agreement governs your use of the Sunshine Send mobile application and the remittance services provided through it (together, the "App" or "Services"). By creating an account or using the Services, you agree to be bound by all the terms and conditions in this Agreement. Our collection and use of your personal information is described in our separate Privacy Policy, as referenced in Section 9.
PLEASE READ THIS AGREEMENT CAREFULLY. IT INCLUDES AN AGREEMENT TO RESOLVE DISPUTES BY ARBITRATION ON AN INDIVIDUAL BASIS.
1. Our Services and Key Partners
Sunshine Send provides a mobile application that allows you to send money from the United States to Receivers in Trinidad and Tobago. Sunshine Send is not a bank. To deliver the Services, Sunshine Send works with licensed and regulated partners.
Payment partners. US Dollar payments from Senders are accepted and processed by licensed payment partners in the United States. The payment methods available to you, such as cash payment at a participating retail location, are shown in the App.
Payout and other partners. Payouts to Receivers in Trinidad and Tobago are made through our licensed payout partner, PayWise. Sunshine Send also works with Shine Technologies Limited trading as Sunshine®, a separate company in Trinidad and Tobago, in connection with the Services. Sunshine Send may add, remove or change its partners at any time.
2. Acceptance of Terms and Partner Terms
By using the App, you agree to this Agreement. Some payment methods and payout services are provided directly by our partners, and you may be asked to accept a partner's own terms when you use them. Where you do, those terms apply to the services that partner provides. If there is any conflict between this Agreement and a partner's terms about a service that partner provides, the partner's terms govern for that service.
3. Eligibility
To use the Services, you must:
- Reside in the United States or one of its territories;
- Be at least eighteen (18) years old;
- Have an acceptable payment method shown in the App; and
- Provide accurate and complete personal information as required for identity verification in compliance with US laws and anti-money laundering regulations.
4. Your Sunshine Send Account
Account Creation. You must create an account to use the Services. You agree to provide true, accurate and complete information.
Identity Verification. To comply with legal requirements, we and our partners will verify your identity before you can send money. You will be asked to provide personal information, which may include your name, address, date of birth, a photo of a government-issued ID, a selfie and in some cases your Social Security Number. Verification is carried out with the help of a third-party identity verification provider.
Screening and Limits. We screen Senders and Receivers against sanctions, watchlist and Politically Exposed Person lists. We set transaction limits, which may be lower for new accounts, and we may ask for more information at any time.
One Account. You may only have one active account.
5. Sending Money
Instructions. When you initiate a transfer, you are giving a binding instruction to Sunshine Send and its partners to complete the transaction.
Transaction Details. Before you confirm a transfer, the App displays the amount you are sending (USD), the exchange rate, the amount the Receiver will receive (TTD) and any fees. You are responsible for reviewing this information carefully, as transactions cannot be cancelled or reversed once confirmed.
Payment. You agree to pay the full amount of the transfer, including our fees, using the payment method you select in the App. A transfer is processed once our payment partner confirms your payment has been received.
Receiver Information. You are solely responsible for the accuracy of the Receiver's information (for example name, email, phone number and area). Sunshine Send is not liable for funds sent to an incorrect Receiver due to an error on your part.
Receiver Verification. Before a Receiver can be paid, they may need to open an account with our payout partner and complete its verification, and we may verify and screen them. We may delay or decline a transfer if a Receiver cannot be verified or does not pass screening.
6. Fees, Exchange Rates and Timing
Fees. Our fees are displayed before you confirm a transaction. You agree to pay all applicable fees.
Exchange Rates. The exchange rate for converting USD to TTD is shown to you before confirmation and is locked in for a limited time. Exchange rates can change.
Timing. We will make reasonable efforts to ensure your Receiver receives the funds promptly. Delivery times may vary due to factors beyond our control, including payment confirmation times, banking hours, holidays, compliance checks, Receiver verification or technical issues with our partners.
7. Refunds, Reversals and Cancellations
No Cancellations. Once you confirm a transaction, you cannot cancel it.
Refunds. If a transaction cannot be completed (for example because the Receiver's information is invalid or the Receiver cannot be verified), we will refund the amount you paid by a method available for your payment method. Refund timing depends on that method and our partners.
Errors. We reserve the right to correct processing errors.
8. Your Responsibilities and Restricted Activities
You agree to use the Services solely for legitimate remittance purposes (for example sending money to family and friends) and not for illegal activities. You must not:
- Violate any law or regulation;
- Use the Services for fraud, money laundering or terrorist financing;
- Send money on behalf of another person without telling us;
- Provide false or misleading information;
- Use the Services in a way that interferes with our or our partners' systems; or
- Circumvent any holds or limitations placed on your account.
9. Data Privacy
Our collection, use and disclosure of your personal information is governed by our Privacy Policy, which is a separate and complete agreement. The Privacy Policy is not part of this Agreement; it is an independent agreement that applies alongside it. By using the Services, you consent to the collection, use and sharing of your information as described in the Privacy Policy and as necessary to process your transactions with our partners.
10. Disclaimer and Limitation of Liability
"As-Is" Services. The Services are provided on an "as-is" basis. Sunshine Send makes no warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.
Limitation of Liability. To the fullest extent permitted by law, Sunshine Send and its affiliates shall not be liable for any indirect, incidental, special or consequential damages arising out of your use of the Services. Our total liability to you for any claim arising from this Agreement is limited to the amount of fees you paid for the specific transaction in question.

You agree to defend, indemnify and hold harmless Sunshine Send, Inc., its affiliates and their respective officers, directors, employees and agents from and against any and all claims, damages, liabilities, costs and expenses (including reasonable attorneys' fees) arising out of or related to your breach of this Agreement, your misuse of the Services or your violation of any law or the rights of a third party.
12. Dispute Resolution and Agreement to Arbitrate
This Agreement is governed by the laws of the State of Delaware. Any dispute or claim arising out of or relating to this Agreement or the Services will be resolved through binding arbitration on an individual basis, in accordance with the Consumer Arbitration Rules of the American Arbitration Association (AAA). The arbitration will be held in Wilmington, Delaware, or by video conference if you prefer.
YOU AND SUNSHINE SEND AGREE TO WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING.
You may opt out of this arbitration agreement by giving written notice to Sunshine Send at support@youfoundsunshine.com within thirty (30) days of first accepting this Agreement.

Assignment. You may not assign this Agreement without our prior written consent.
Relationship to Privacy Policy. This Agreement and the Privacy Policy are separate and independent agreements that together govern your use of the Services. Each remains complete and effective on its own terms.

This Privacy Policy describes how Sunshine Send, Inc. trading as Sunshine Send ("Sunshine Send," "we," "us," or "our") collects, uses, discloses and protects your personal information when you use the Sunshine Send mobile application and remittance services (together, the "App" or "Services"). It is a separate and complete agreement that works alongside our Terms of Use.
PLEASE READ THIS PRIVACY POLICY CAREFULLY. BY CREATING AN ACCOUNT OR USING THE SERVICES, YOU AGREE TO THE COLLECTION AND USE OF YOUR INFORMATION AS DESCRIBED HERE.
1. Introduction and Relationship to Terms of Use
This Privacy Policy supplements, and should be read together with, our Terms of Use. It is not incorporated into the Terms of Use; each is an independent agreement that applies to your use of the Services. Capitalised terms not defined here have the meaning given to them in the Terms of Use. If this Privacy Policy and the Terms of Use conflict about the collection, use or disclosure of your personal information, this Privacy Policy governs, except where applicable law requires otherwise.
2. Information We Collect
Account and Identification Information: information you give us when you create an account, such as your full name, physical address, email address, phone number, date of birth and Social Security Number (or other government-issued identification numbers).
Identity Verification Information: photos of your government-issued ID and selfie photos, collected through our identity verification provider. To confirm that you are the person shown on your ID, the provider may create a facial geometry template from these photos, which is biometric information. See Section 5 for how long it is kept.
Payment Information: details of how you pay for each transfer, such as the payment method, payment reference, location of the participating retail store and confirmation of payment from our payment partners. If you pay from a bank account, this includes the account and routing numbers needed to collect your payment.
Transaction Information: details of each transaction, including the amount sent, the exchange rate applied, fees, the Receiver's information and the time and date of the transfer.
Device and Usage Information: information about your device and how you use the App, such as your IP address, device type, unique device identifiers, operating system and an approximate location based on your IP address (for fraud prevention and risk management). The App does not access your device's precise location.
Contacts: if you allow the App to access your contacts, you can choose a contact to fill in a Receiver's details. Only the details of the contact you select are sent to us. We do not upload your contact list.
Receiver Information: to deliver funds, we collect information about your Receiver, such as their name, email, phone number and area in Trinidad and Tobago, and the results of their verification and screening. You must have the Receiver's permission to share this information with us.
3. How We Use Your Information
We use your information to:
- Provide, process and manage your transactions;
- Verify your identity and screen Senders and Receivers to comply with US anti-money laundering (AML) and counter-terrorist financing (CTF) laws;
- Communicate with you about your account and transactions;

- Resolve disputes and enforce our Terms of Use; and
- Comply with legal and regulatory obligations, including responding to lawful requests from government authorities.
4. How We Disclose Your Information
We share your personal information with third parties only as necessary to provide the Services and as permitted by law. This includes:
Our Partners: our licensed payment partners in the United States, which accept and process your US Dollar payments; Shine Technologies Limited trading as Sunshine®, a separate company in Trinidad and Tobago; and PayWise, our licensed payout partner in Trinidad and Tobago, which pays and verifies Receivers.
Service Providers: trusted third parties that perform functions on our behalf, such as identity verification, sanctions screening, fraud prevention and data storage. They are contractually required to protect your information and may not use it for any other purpose.
Affiliates: our affiliates, for purposes consistent with this Privacy Policy.
Legal and Regulatory Compliance: when we believe disclosure is required by law, such as in response to a subpoena, court order or similar legal process, or to comply with laws, regulations or government requests.
Business Transfers: in a merger, acquisition, reorganisation or bankruptcy, your information may be transferred to the new entity, subject to this Privacy Policy.
Important Note: We do not sell or rent your personal information to third parties.
5. Data Security and Retention
We maintain physical, electronic and procedural safeguards, in line with applicable US federal and state regulations, to protect your information from unauthorised access, use or disclosure.
We keep your personal information for as long as needed for the purposes in this Privacy Policy and to meet our legal obligations, including record-keeping and anti-money laundering requirements. This may extend beyond the end of your relationship with us.
Biometric information. Facial geometry templates are used only to verify your identity and prevent fraud. They are never sold, leased or traded. They are permanently deleted once the purpose of verification has been met, and in any case within three (3) years of your last interaction with us, unless the law requires us to keep them longer. By completing selfie verification you consent to this collection and use.
6. Your Privacy Rights
You may have rights to access, correct or delete your personal information, subject to legal and partner limitations, such as anti-money laundering record-keeping. To use these rights, contact us using the details in Section 8.
